This End User License Agreement ("Agreement" or "EULA") is between you ("User," "you," or "your") and Bluetick Network LLP ("Bluetick," "Company," "we," "us," or "our"). This Agreement governs your use of the Bluetick mobile application ("App" or "Software") available on iOS and Android platforms.
Subject to the terms of this Agreement, Bluetick grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on mobile devices that you own or control.
The App and all copies thereof are proprietary to Bluetick and title remains with Bluetick. All rights in the App not specifically granted in this Agreement are reserved by Bluetick.
Bluetick owns all right, title, and interest in and to the App, including software code, architecture, user interface elements, documentation, trademarks, and slogans.
You retain ownership of content you create using the App. By using the App, you grant Bluetick a limited license to process, store, and display your content solely to provide the service to you.
If you provide feedback, suggestions, or recommendations about the App, you grant Bluetick an unlimited, irrevocable, perpetual, royalty-free license to use such feedback for any purpose.
4.1 Automatic Updates: Bluetick may from time to time develop patches, bug fixes, updates, upgrades, and other modifications ("Updates"). You agree that we may automatically install Updates, with or without notice.
4.2 Feature Changes: We reserve the right to add, modify, or remove features from the App at any time. Premium features may be added, changed, or discontinued with reasonable notice.
4.3 Required Updates: Some Updates may be required for continued use of the App. If you do not install required Updates, certain features may not function correctly.
The App may utilize third-party services that change independently of our control. Your use of such services is subject to the third party's terms and conditions.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
BLUETICK DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
7.1 IN NO EVENT SHALL BLUETICK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
7.2 BLUETICK'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR INR 5,000, WHICHEVER IS GREATER.
You may terminate this Agreement at any time by uninstalling the App from all your devices and discontinuing use of the services.
We may terminate or suspend your license immediately, without prior notice, if you breach any term of this Agreement, or for any other reason at our sole discretion.
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India.
For iOS users, this Agreement is between you and Bluetick only, not with Apple. Apple has no obligation to provide maintenance or support. Apple is not responsible for any claims relating to the App.
For Android users, this Agreement is between you and Bluetick only, not with Google. Google Play's terms also apply to your use of the App.
